Terms and Conditions of Membership
This agreement applies as between you, the User of the Bord Gáis Energy Rewards Club and Bord Gáis Energy Limited, the owner of the Bord Gáis Energy Rewards Club and website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Bord Gáis Energy Rewards Club website. If you do not agree to be bound by these Terms and Conditions, you should stop using the Bord Gáis Energy Rewards Club website immediately.
1. Membership of the Rewards Club
1.1 Membership of the Bord Gáis Energy Rewards Club is available to all residential Bord Gáis Energy customers who agree to these terms and conditions of use and who register to become a Rewards Club member.
1.2 To join the Bord Gáis Energy Rewards Club you must complete the Registration Form providing all mandatory details and preferences where indicated.
1.3 Membership of the Bord Gáis Energy Rewards Club entitles you to:
(a) Receive emails and/or text messages from us with details of Rewards Offers (at Bord Gáis Energy’s discretion).
(b) You can avail of these Offers (subject to availability) by using the details provided to you in the email or text message that we send to you or by following the steps on the Rewards Club website (www.bordgaisenergyrewards.ie).
(c) Ticketmaster is responsible for issuing your ticket/s and your contract for the ticket/s is with Ticketmaster. You should refer to Ticketmaster’s terms and conditions for further details. (Ticketmaster may charge you a booking fee for all tickets bought online).
(d) Each Member of the Bord Gáis Energy Rewards Club can purchase the pre-determined amount of tickets for each offer (subject to availability).
(e) By becoming a member of the Bord Gáis Energy Rewards Club and agreeing to these Terms and Conditions of Membership, you agree that we will communicate with you about the Rewards Club by email or text message. You may un-subscribe from these messages at any time using the links or details provided on the message.
1.4 To access your account you must log in by completing your user name and password. You are responsible for the safekeeping of your user name and password and shall take all necessary steps to ensure that your log-in details remain confidential. You are responsible for all activities carried out under your user name and password, whether authorised or not. If you believe that the security of your user-name and password may be compromised for any reason, please inform us and change your user-name and password immediately. Bord Gáis Energy is entitled to assume, without further inquiry, that all activities conducted under your user name and password are being carried out by you until you inform us otherwise.
1.5 Each Member may add one “Nominated User” to their account. Please note that there will only be one account with one Primary Member and one Nominated User (if applicable). A Nominated User is subject to these terms and conditions of the Rewards Club. If the primary member de-registers from the Bord Gáis Energy Rewards Club, the nominated user will also be de-registered. The Primary Member can also remove the nominated user if they so wish. The Primary Member agrees that he/she has the permission of the Nominated User to add them to the account and provide us with their details.
1.6 You may de-register from the Bord Gáis Energy Rewards Club at any time by following the “de-register steps” on our website or by calling 01 611 01 01.
1.7 Bord Gáis Energy will automatically de-register you from the Bord Gáis Energy Rewards Club if you cease to be a Bord Gáis Energy customer.
2.1 The Bord Gáis Energy Rewards Club website is subject to Bord Gáis Energy Limited’s Data Protection Notice and privacy policy.
3.1 All content included on the Bord Gáis Energy Rewards Club website, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Bord Gáis Energy Limited or our affiliates or third party licensors. Bord Gáis Energy Limited grants you a limited licence to use such content solely for your own personal non-commercial use in connection with the Bord Gáis Energy Rewards Club. You shall not store, modify transmit, distribute, broadcast, or publish any part of the content for any other purpose. The re-selling, copying or incorporation into any other work of part or all of the material available on the Bord Gáis Energy Rewards Club website in any form is prohibited save that you may print or download extracts of the material on this site for your personal information only.
4.1 You will indemnify Bord Gáis Energy Limited against any loss, damage or expense which it incurs as a result of any failure by you to comply with these terms and conditions.
4.2 Except as expressly set out in these terms and conditions, all representations, warranties, terms and conditions, whether express or implied, and all liability on the part of Bord Gáis Energy Limited in relation to the Bord Gáis Energy Rewards Club or the information contained on this website are hereby excluded to the greatest extent permitted by law.
4.3 Bord Gáis Energy Limited has no liability for any ticket issued to you as a Rewards Club offer. Your contract is with Ticketmaster and you should refer to Ticketmaster’s terms and conditions of contract.
5.1 The Bord Gáis Energy Rewards Club website may be withdrawn or varied at any time by Bord Gáis Energy. We reserve the right to vary these terms and conditions at any time and will notify you of the proposed changes. By continuing to use the Bord Gáis Energy Rewards Club website after being notified of the changes you will be deemed to have accepted such changes.
5.2 We may suspend any or all of the Bord Gáis Energy Rewards Club website at any time for such reason as we may consider necessary to allow us to inspect, maintain, renew, repair or revise it.
5.3 We reserve the right to suspend or terminate your use of the Bord Gáis Energy Rewards Club website at any time if you do not adhere to these terms and conditions of use or if you do not use the offer ticket/s for your own use and attempt to sell them on for a profit or if any other abuse of the Bord Gáis Energy Rewards Club is deemed to have occurred (at Bord Gáis Energy’s discretion).
5.4 Due to the global nature of the Internet you agree to comply with all local rules regarding on-line conduct and acceptable content. You also agree to comply with any applicable rules regarding the export of any technical data from any country.
5.5 The opinions expressed in material submitted via this website are not necessarily those of Bord Gáis Energy Limited. Any statements, advice and opinions made by persons submitting content are those of such persons only. Bord Gáis Energy Limited neither endorses nor shall be held responsible for the reliability nor accuracy of same.
5.6 Bord Gáis Energy Limited shall not be liable for any loss suffered by any person or be deemed to be in default for any delays or failures in performance hereunder resulting from acts or causes beyond the reasonable control of Bord Gáis Energy Limited.
5.7 These terms and conditions shall be governed by and construed in accordance with the laws of Ireland and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the Irish courts.
